Terms of Service

This is a working draft for review. Final legal language is to be reviewed and finalized by counsel (Todd Nurick) before launch.

1. Acceptance of these Terms

Gravitas Universe (the “Service”) is operated by ALHC (“ALHC,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms of Service (the “Terms”) and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

2. Eligibility & accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. One person may not maintain more than one account except as expressly permitted by us.

3. The Service

Gravitas Universe is a gamified professional platform for hospitality workers. It lets you build a profile, complete training scenarios and challenges, earn experience points (XP), ranks, streaks, and an altitude score, appear on leaderboards, and — where you choose to — make yourself discoverable for opportunities. XP, ranks, badges, tickets, and similar in-product rewards have no cash value, are not transferable, and may be adjusted, expired, or reset to preserve the integrity of the game.

4. Acceptable use

You agree that you will not:

• break the law, infringe anyone’s rights, or use the Service for any unlawful, fraudulent, or harmful purpose;
• submit false profile, work-history, or identity information, or impersonate any person or organization;
• cheat, automate, script, exploit, or otherwise manipulate gameplay, scoring, streaks, leaderboards, or rewards;
• upload content that is harassing, hateful, defamatory, obscene, or that contains malware;
• scrape, harvest, reverse-engineer, or attempt to gain unauthorized access to the Service, other accounts, or our systems; or
• interfere with, overload, or disrupt the Service or the experience of other users.

We may investigate suspected violations and may suspend or terminate access, remove content, or adjust scores and rewards as a result.

5. Your content

You retain ownership of the content you submit (for example, your profile details, bio, photos, and work history). You grant ALHC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely as needed to operate, provide, secure, and improve the Service — including, where you have opted in, making your profile discoverable to potential employers. You represent that you have the rights necessary to grant this license.

6. Intellectual property

The Service itself — including its software, design, holographic visual system, gameplay mechanics, scenarios, challenge content, scoring models, text, graphics, and the Gravitas Universe name and marks — is owned by ALHC or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you to use the Service, no rights are transferred to you. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written permission.

7. Opportunities & third parties

Gravitas Universe may surface job or opportunity information and may, with your opt-in, make your profile visible to hospitality employers and staffing partners. ALHC is not the employer for any opportunity surfaced through the Service, does not guarantee any job, interview, placement, or outcome, and is not a party to any agreement you may enter with a third party. Your dealings with third parties are solely between you and them.

8. Communications & consent

By creating an account you agree to receive service-related messages necessary to operate the Service. Marketing or outreach communications (including SMS/text and calls to any phone number you provide) are sent only where you have given the separate, affirmative consent described in our Privacy Policy, and you may withdraw that consent at any time. Message and data rates may apply.

9. Termination

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any scores, rankings, or opportunity information are accurate or complete.

11. Limitation of liability

To the fullest extent permitted by law, ALHC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, opportunity, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars (USD $100).

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the version and effective date above and, where appropriate, notify you or ask you to re-accept. Your continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules.
